1. Agreement
By using heightsgoods.com or hiring Heights Goods for services, you agree to these terms. If you don't agree, please don't use the site or hire us. These terms cover both website visitors and project clients.
Heights Goods ("we," "us," "our") is a Houston-based studio providing design and production services for branded merchandise.
2. Our Services
We design, source, produce, and deliver custom branded merchandise. Specific services include but are not limited to: custom apparel, headwear, kits, gifts, events & activations, displays, signage, large-format pieces, and paper goods.
Every project is custom-quoted. We don't sell products from a catalog. Project pricing, timelines, materials, and deliverables are agreed in writing before work begins.
3. Project Process & Quotes
Quotes provided by Heights Goods are valid for 30 days from the date issued. Quotes are based on the information available at the time and may be revised if project scope, materials, quantities, or timelines change.
Once a quote is accepted, we typically require a deposit before work begins. Specific payment terms are stated in each project agreement.
We produce physical samples before any production run. You'll approve samples before we proceed with full production. Changes after sample approval may require additional time and cost.
4. Payment
Standard payment terms:
- Deposit due at project start (typically 50%)
- Balance due before shipping or delivery
- Net terms available for established clients
- Accepted payment: ACH, wire transfer, check, or credit card (card surcharges may apply)
Late payments may incur a fee of 1.5% per month on outstanding balances.
5. Intellectual Property
Your brand assets: Logos, trademarks, and brand materials you provide remain your property. By sharing them with us, you grant us the right to use them only for the purpose of producing your project.
Our design work: Designs we create for your project become your property upon full payment. Until then, all designs remain the intellectual property of Heights Goods.
Portfolio rights: Unless explicitly agreed otherwise in writing, we reserve the right to display completed work in our portfolio, case studies, and marketing materials. We never share client information that wasn't publicly available.
You confirm that you have the right to use any brand assets, designs, or content you provide to us.
6. Production & Delivery
Production timelines are estimates based on industry standards and current capacity. We'll communicate any delays as soon as we know about them.
Shipping is at the client's expense unless otherwise agreed. Risk of loss transfers to the client upon delivery to the shipping carrier.
For projects involving multiple production partners or international manufacturing, customs, duties, and import fees are the client's responsibility unless explicitly included in the quote.
7. Quality & Returns
We stand behind our work. If a delivered product has a manufacturing defect or doesn't match the approved sample, contact us within 14 days of delivery and we'll make it right — typically through replacement or partial refund.
Custom-produced merchandise generally cannot be returned for reasons unrelated to defect (changed mind, wrong size ordered by client, etc.).
8. Cancellation
You may cancel a project before production begins, subject to:
- Design fees for work completed
- Material costs already incurred
- Production costs already initiated
Cancellation requests after production has started may not be possible to fulfill — we'll work with you in good faith to find a fair resolution.
9. Website Use
You may use heightsgoods.com for personal and business research. You may not:
- Copy or reproduce content for commercial purposes
- Use automated tools to scrape the site
- Attempt to disrupt or compromise the site
- Use the site to send spam, malware, or harmful content
10. Disclaimers & Liability
We provide our services with reasonable care. To the extent permitted by law, we disclaim all implied warranties. Our total liability for any claim related to our services is limited to the amount you paid us for the specific project at issue.
We're not liable for indirect, incidental, or consequential damages. This includes lost profits, lost data, or business interruption.
11. Confidentiality
We treat client information and project details as confidential. We don't share details about active projects with third parties (other than necessary production partners) without permission.
If your project requires a formal NDA, we're happy to sign one before sharing detailed information.
12. Governing Law
These terms are governed by the laws of the State of Texas. Any disputes will be resolved in courts located in Harris County, Texas.
13. Changes
We may update these terms occasionally. Material changes will be posted here with a revised date. Continued use of the site or our services after changes constitutes acceptance.
